Terms & Conditions VanCootens Community Rewards
Effective Date: 18 January 2025
These terms and conditions apply to your participation in the VanCootens Community Rewards (Program). In this document, when we say we, us, our (etc.) we are referring to KAD CHEW PTY LTD AFT CHEW FAMILY TRUST ABN 60269925747 Trading as VanCootens. When we say the Site this refers to vancootens.com. When we say you, your (etc.), we mean the individual who is a member of the Program.
Your agreement with us
We own and operate the Program. Your registration for, or participation in, the Program constitutes acceptance of these terms and conditions. We may vary the terms and conditions of the Program from time to time and the current version of the terms and conditions will always be available on the Site. We will give you reasonable notice (including by posting on the Site and/or by email) of any changes to these terms and conditions. If you do not accept changes to the terms and conditions you can terminate your membership by contacting us (see “Leaving the Program” below). If you continue to participate in the Program that will constitute acceptance of the updated terms and conditions.
Your privacy is important to us
VanCootens is committed to the protection of the privacy and rights of individuals in relation to their personal information. This Privacy Policy tells you how we collect, hold, use and disclose your personal information in connection with your participation in the Program. This Privacy Policy does not apply to our handling of personal information in other contexts. You should also be aware that the handling of personal information by third parties will be subject to those third parties’ own privacy policies. We may update this Privacy Policy from time to time, and will post the updated version on the Site.
The types of personal information we collect and hold about Program members may include:
name(s); contact details (e.g. address(es), email address(es), telephone number(s)); other identification information (e.g. date of birth, membership numbers or other personal identifiers related to your participation in the Program);
transaction information / history (including details of the products you purchase, and the value of your purchases);
reward details (including details of reward redemptions); records of your communications and interactions with us and in connection with the Program;
From time to time, you may provide us, and we may collect from you, the personal information of a third party. Where you provide the personal information of third parties, you agree that you will ensure that those persons are aware of this Privacy Policy, and that you have their consent to provide the information to us.
How do we collect your personal information in connection with the Program?
We may collect your personal information from your interactions and transactions with us. This includes when you:
email or contact us, or we otherwise have conversations with you (such as in-store or over the telephone); or
have other dealings with us, or otherwise in the course of us providing you with a requested product, service or benefit.
For VanCootens Community Rewards program members, we may also collect your information when you:
register to participate in the Program directly with us
use the loyalty card which has been linked to your Program account, including when you make a purchase instore;
participate in a promotion, competition or survey in connection with the Program; and/or
redeem a reward or access an offer provided in connection with the Program.
How do we hold and protect your personal information?
We hold personal information in a combination of computer storage facilities, paper-based files and other records, both at our own premises and with the assistance of service providers. In so doing, we take reasonable steps to protect your personal information from misuse, interference and loss, and unauthorised access, modification or disclosure. When we no longer need your personal information, we take reasonable steps to destroy or permanently de-identify the information.
Consequences if you do not provide personal information
If you do not provide your personal information, we may not be able to provide you with products, services or benefits in connection with the Program. For example, if you have not provided your email address, we will not be able to issue personalised email communications.
Why do we collect, hold, use and disclose your personal information?
We handle your personal information for the purposes of providing, administering, improving and personalising the Program, our products and services, and the products and services of VanCootens and Program participants. This can include, to the extent permitted by law: registering you to participate in the Program; providing Program benefits; managing Program promotions and competitions; and Retailer-related promotions for Program members; offering and facilitating the offer of other Program benefits; offering and facilitating the offer of other products or services that may be of interest to you; verifying your identity, communicating with you (including through direct marketing); understanding your interests and preferences to help us tailor our communications and offers and to improve our offerings; handling your queries and complaints; assessing the performance of Program digital platforms and improving their operation; for other data analytics purposes, including to provide VanCootens with information about the purchasing trends of members who have registered and to provide aggregated, anonymous information about Program activity, shopper trends and campaign/promotional performance, and other Program insights; conducting surveys, and market and product research; otherwise providing goods, services and benefits you have requested or are eligible to receive in connection with the Program; working with our service providers; and any other purposes which we have notified to you at the time of collection of the information, or to which you have provided your consent.
We may also handle your personal information:
to protect, defend and enforce our legal rights and obtain professional advice;
to comply with industry standards and our policies;
to maintain and update our records;
as required or authorised by law or a court or tribunal order.
Direct marketing
Where we have your consent or are otherwise permitted by law to do so, we may also use and disclose your personal information to provide you with marketing communications and targeted advertising on an ongoing basis by electronic messages (such as email), through our digital services and by other means. These communications may be sent by third parties on our behalf. These communications may relate to the products and services we provide, promotions run by us or for which there is automatic entry for Program members, and other products or developments which may be of interest to you. You may opt-out of receiving future electronic and communications through the unsubscribe function that will be made available to you with each direct marketing communication although this may limit your ability to receive the benefits of the Program.
We may disclose your personal information to:
various third party service providers we engage in connection with the Program, including service providers who assist with the development, administration, marketing or improvement of the Program, or with Program-related data processing/analysis; government bodies and regulatory authorities, including if required or authorised by law
If you have any questions about this Privacy Policy, if you wish to update or request access to information we hold about you, or if you wish to make a complaint about our collection, use or disclosure of your personal information in connection with the VanCootens Community Rewards Program, please contact us in-store.
How to get started
Membership of the Program is free. In order to join the Program you must meet the eligibility requirements (see further under “Your and our responsibilities” below). Otherwise, to join you will need to: register your account in-store. If you do not provide the information requested in the registration process, you may not be able to fully participate in the Program. As part of the registration you will need to:
provide a valid email address;
agree to receive communications (including by electronic means) as part of the Program.
The Program is a loyalty program through which we provide member offers, deals and promotions (including third party offers, deals and promotions), targeted communications, and the opportunity to participate in competitions and prize draws. The Program is reliant on electronic communications. By agreeing to participate in the Program you agree to receive electronic communications about the Program, the products and services offered through the Program, details of promotions and other benefits. If we determine that your email address is not valid, or if you unsubscribe from receiving future electronic communications about the Program or offers provided under the Program, you may not be able to receive some or all of the Program benefits and we may suspend or terminate your participation in the Program in whole or in part. Once you are a registered Program member you will have access to all the current benefits. Your eligibility to receive Program benefits may be reduced or removed if you do not complete all of the information requested at registration.
Your and our responsibilities
Any VanCootens Community Rewards branded Card issued to you remains our property. You are responsible for its safekeeping, and for the security of it. To be eligible for a Program account you must:
be a resident of Australia;
be aged 18 years or over;
use your real full name and only provide accurate information to us in relation to the Program;
only maintain one Program account at any given time; and
have full power and authority to register for the Program and accept these terms and conditions.
You must give us accurate information about yourself (including as part of the registration process) and update your account with any changes to that information. You must not use your Card, the Site or any Program benefits we provide to you in any unauthorised or illegal manner. Our responsibility is to provide the Program in accordance with these terms and conditions, as updated from time to time in accordance with these Terms & Conditions. We are not responsible if you are unable to access or receive Program benefits as a result of your failure to comply with these Terms & Conditions, including a failure to provide accurate details or update your details in your account. Where we reasonably believe it is necessary to protect your or our interests, we may decline to issue, withdraw, suspend or cancel your Program accounts and/or Cards, in whatever form, and remove you from the Program or remove Program benefits at any time, including if we reasonably believe that you:
are abusing or attempting to abuse the Program;
have materially breached these terms and conditions or the terms and conditions of any Program offers or benefits; or
are involved in any behaviour relating to our Program that involves theft, fraud, misconduct, abusive, offensive or other inappropriate behaviour, or the supply of false or misleading information.
The Program is only for personal and consumer use. The Program cannot be used for any business transaction or purpose.
Collecting & Redeeming Points
$1 spent in-store at VanCootens = 1 point. When shopping in-store, let us know you’re an Rewards Member at the start or during check-out and we'll add the purchase to your account. You’ll need to give us your membership card or your personal Rewards Membership number at the time of transaction. We are unable to apply your purchase amount after the transaction has been completed. It is the Program members responsibility to provide staff with membership information prior to the transaction completion.
All items are eligible for points, except for cigarette & tobacco products and gift cards.
Accumulated points will be be shown on your transaction receipts. Points do not expire.
For every 1000 points accrued a $10 credit will be automatically applied to your account. Once this credit has been applied you are able to redeem this amount during any membership transaction excluding on cigarette & tobacco products. Membership information (card or account number) must be provided at the time of transaction to redeem credit amount.
You can choose to donate your credit to a local community group or association. A list of available groups/associations are provided below and in-store. You will be required to complete a Transfer of Rewards Credit Form for this process to be completed in-store. Once this form is completed and processed in-store the credit amount will be removed from the member account and directly applied to the account of your chosen local group/association.
Program member offers and rewards
The purpose of the Program is to reward your loyalty to VanCootens and provide you with member deals and benefits, as well as to enable us, participating suppliers and other Program partners to gain insights into shopper trends, store and marketing campaign performance and other aspects of customer behaviour and retail performance. This will enable us to provide you with relevant offers and enhance your experience as a valued VanCootens customer. Benefits of participation in the Program may include:
in-store member deals;
targeted marketing communications in relation to the Program and the offers and deals provided under the Program
You must present your Card at the checkout to take advantage of any in-store benefits and follow the directions provided in member communications and offers to access other Program benefits. Cards do not have any monetary value and are not exchangeable for cash.
Excluded Products
Certain products, including cigarette, tobacco and tobacco-related products and gift cards do not qualify for Program discounts and savings, and will not be included in the calculation of qualifying spend or other offers. Other products may be added to the above list of excluded products at our discretion.
In-store member deals
In-store member deals will include discounts and savings on selected products from time to time. Product deals, special offers and other benefits are determined by us in our complete discretion and may vary from time to time. We have no obligation to you to make available any deals, offers or benefits in any particular period or at all. Availability of member deals depends on stock availability.
Other member rewards and benefits
Any other member rewards or benefits which we offer from time to time will be published at vancootens.com
Lost, damaged or stolen Cards
If your Card is lost, damaged or stolen, please contact us so you can be issued with a new card. If you notify us that a Card has been lost or stolen we reserve the right to suspend or cancel the relevant account.
Changes to / Cessation of the Program
We are under no obligation to continue to offer the Program. We reserve the right to change the Program (including Program benefits) at any time. We will give you reasonable notice, including by posting on the Site and/or via email, of any change to the Program prior to those changes coming into effect. If you do not accept changes to the Terms, you can cancel your membership (see “Leaving the Program” below).
Leaving the Program
You can choose to leave the Program at any time. You may cancel your membership by using the “Contact us” option on the Site or by any other account-closure method we may make available from time to time. If you cancel your membership, you will not be eligible to receive Program member benefits and any pending benefits not already received by you will be automatically forfeited. If you used your membership of the Program to accept a third party offer, your agreement with that third party will remain subject to its own terms.
Third parties and our liability
While we own the Program, we have third parties that help us operate it. You acknowledge that we, our related bodies corporate and our third party service providers will handle your data. If you are also a member of a Third Party Program, the operator of that Third Party Program may also use your data in accordance with its own terms and conditions and privacy policy. We may receive data from the Third Party Program provider, and may also provide your data to them in connection with our administration of the Program and to enable your enrolment in their program (see under “Third Party Programs” for more information). You also acknowledge that third party offers that may be made as part of the Program are made on behalf of those third parties and that we are not responsible for providing and do not endorse those third parties or third party offers. VanCootens is not responsible for any agreement you subsequently enter into with a third party as a result of a third party offer. Consumer protection legislation may confer rights and remedies on you which cannot be excluded, restricted or modified (Non-excludable Rights). Nothing in these terms and conditions is intended to exclude, restrict or modify your Non-excludable Rights. Nevertheless, to the maximum extent permitted by applicable law, you agree that we will not be liable to you for any loss, damage, cost or expense you may suffer:
due to VanCootens and other Program participants’ conduct, representations, products and/or services, except to the extent we or our associated agencies and companies have caused or contributed to such loss, damage, cost or expense;
due to events beyond our reasonable control;
in connection with the Program or the Site, except to the extent we or our associated agencies and companies have caused or contributed to such loss, damage, cost or expense; or
as a result of the suspension or termination of your account in accordance with these terms.
Disclaimer
Subject to your Non-Excludable Rights, we do not warrant or represent that the functions contained on the Site will be uninterrupted and do not warrant that the Site or its server is free of computer viruses, bugs or other harmful components. Unless otherwise noted, all materials on the Site are protected as copyright, trade names, trade marks or are other intellectual property owned by us and/or our affiliates or by other parties that have licensed their material or trade marks to us. Other than viewing and downloading content from the Site for purposes permitted on the Site, you do not have the right to use these intellectual property rights without the written permission of their owner. You agree that you will not use the Site for any unlawful or improper purpose. You will not violate or attempt to violate the security of the Site. All rights not expressly granted are reserved. Links may be included on the Site which will allow you to connect with sites that are not under our control. We provide these links only as a convenience. The appearance of a link does not imply our endorsement, nor are we responsible for the contents of any linked site. You access them at your own risk. You should carefully review the terms of use and privacy policies of all external websites that you visit.
General
Your use of the Program does not grant you any rights in the Program. This document is governed by and construed in accordance with the laws of Queensland, Australia. These terms and conditions supersede any and all prior terms and conditions where notice has been provided pursuant to these terms and conditions. If any provision of these terms and conditions is found to be unenforceable under Queensland law, this will not affect the remainder of the provisions of these Terms, which will remain in full force and effect. A failure to enforce any right or provision of these terms and conditions will not restrict either you or us from enforcing that right or provision now or in future.
